AEvice Health Pte Ltd warrants that the AireSone Junior Device will be free from defects in materials and workmanship, under normal use and service, for a period of one (1) year from the date of the purchase receipt (“Warranty Period”). This Limited Warranty is only available to the original purchaser of the AireSone Junior Device.

At its option, AEvice Health may repair or replace the defective AireSone Junior Device or defective component part(s) in accordance with the terms of this Limited Warranty. The replacement unit will be warranted only for the unexpired period of the original device’s applicable warranty period or 14 days, whichever is longer, or for any additional period of time that may be applicable in your jurisdiction.

This Limited Warranty does not apply if the AireSone Junior Device has been damaged as a result of misuse, modifications or improper maintenance. This Limited Warranty is the only warranty for the AireSone Junior Device. No one is authorized to make any other warranty on behalf of this device.

If a hardware defect arises and a valid claim is received by AEvice Health within the Warranty Period, AEvice Health will, at its option and to the extent permitted by the applicable law, either (1) repair the product at no additional charge, using new or refurbished parts, or (2) exchange the product with a new or refurbished product. If AEvice Health, in its sole discretion, determines it is not reasonable to replace the defective product or component part(s), AEvice Health may refund the purchase price paid for the product. In the event of a defect, to the extent permitted by law, these are your sole and exclusive remedies.

Shipping and handling charges may apply unless prohibited by applicable laws. This Limited Warranty is valid only in the jurisdictions where the products are sold by AEvice Health itself or through its authorized reseller or agent, and is valid to the extent permitted by the applicable laws of such jurisdictions. A proof of purchase must be kept for warranty purposes. Any replacement hardware product will be warranted for the remainder of the original warranty period or 14 days, whichever is longer, or for any additional period of time that may be applicable in your jurisdiction.

It is your responsibility to backup any data, software or other materials you may have stored or preserved on the product. It is likely that such data, software or other materials will be lost or reformatted during the service, and AEvice Heath will not be responsible for any such damage(s) or loss(es).

This Limited Warranty applies only to the product manufactured by or for AEvice Health that can be identified by the “AireSone” trademark, trade name, or logo affixed to it. The Limited Warranty does not apply to any (a) AEvice Health products and services other than the AireSone Junior Device, (b) consumables (such as batteries, patches, etc.), or (c) software, even if packaged or sold together with the product or embedded in the product. Please refer to the Terms and Conditions set out on the AireSone mobile application and the AireSone website (www.airesone.com).

THE PRODUCT IS NOT A MEDICAL DEVICE; IT IS NOT REGULATED OR APPROVED BY THE U.S. FOOD AND DRUG ADMINISTRATION, THE U.K. MEDICINES AND HEALTHCARE PRODUCTS REGULATORY AGENCY, OR THE HEALTH SCIENCES AUTHORITY OF SINGAPORE; IT IS NOT DESIGNED TO DETECT OR PREVENT CAUSES OF SUDDEN INFANT DEATH SYNDROME, ASTHMA, OR OTHER MEDICAL CONDITIONS. THE PRODUCT IS INTENDED TO BE USED WITH AIRESONE’S MOBILE APPLICATION TO HELP YOU MONITOR YOUR CHILD’S HEALTH PROGRESS AND WELLNESS. IT IS NOT A SUBSTITUTE FOR MEDICAL CARE OR ADULT SUPERVISION.

AEvice Health does not warrant that the operations of the product will be uninterrupted or error-free. AEvice Health is not responsible for damages arising from failure to follow instructions relating to the product’s use.

This warranty does not apply to a product or part of a product that has been altered or modified (e.g. to alter its functionality or capability) by anyone who is not a representative of AEvice Health. In addition, this Limited Warranty does not apply to: (a) damage caused by the use with non-AEvice Health products; (b) damage caused by accident, abuse, misuse, spillage of food or liquid or other external causes; (c) damage caused by operating the product outside the permitted or intended uses described by AEvice Health or with improper voltage or power supply; (d) use for medical, healthcare, or treatment purposes; (e) damage caused by misusing AireSone Junior Device’s Silicone Patch or replacing it with other materials, or (f) damage caused by service performed by anyone who is not a representative of AEvice Health. Recovery and reinstallation of software programs and user data are not covered under this warranty.

This warranty is void if a product is returned with removed, damaged, or tampered labels or any other alterations (including the unauthorized removal of any component or the external cover of the device).

No AEvice Health reseller, agent, or employee is authorized to make any modification, extension, or addition to this Limited Warranty. If any terms is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES AND CONDITIONS (INCLUDING WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY.

Some jurisdictions do not allow limitations on the duration of an implied warranty or condition, so the above limitation may not apply to you. Notwithstanding this warranty, you may have other legal rights depending on the jurisdiction in which you reside in.

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, AEVICE HEALTH SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS, REVENUE OR DATA, RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, EVEN IF AEVICE HEALTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL OR EQUITABLE THEORY.

Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental, or consequential damages, so the above limitation or exclusion may not apply to you.

This Limited Warranty shall be governed by the laws of Singapore, without giving effect to any conflict of laws or principles that may provide the application of the law of another jurisdiction.
